Application for a Use Permit, pursuant
to Article 15.4(e) of the Zoning Ordinance, to allow a restaurant
to serve beer and wine for on-site consumption (within the
restaurant and its outdoor patio located in the rear). The
total floor area of the restaurant is approximately 980 square
feet; the lot size is approximately 4,300 square feet, containing
six parking spaces and a new trash enclosure. The property
is located in the General Commercial-Residential (CG-R) Zoning
District.

Application for a Variance, per the requirements
of Ordinance No. 1130, Article 5.9B(1) for an encroachment
into the side yard for a new one car garage, which is proposed
to be built 18 inches from the northern property line and
six feet from the rear property line. The required
side yard setback is five feet and the rear yard setback
is six feet. The existing one car garage is constructed 18
inches from the northern property line and 29 feet from the
rear property line. The property is in the “R-1” (Residential—Single
Family) District.
